Terms and conditions of use

Article 1 - Introduction

These Terms and Conditions of Use (the ‘TCU’) govern the use of our products (MyEnglishDrill) on your platform, whether you are a private user, public institution or company.

The Terms and Conditions are agreed between My Language Drill Sàrl (hereinafter referred to as ‘MLD’), a company incorporated under Swiss law based in Epalinges (VD), and any natural or legal person governed by private or public law who has a Customer Account with MLD (hereinafter referred to as the ‘Customer’).

By using our services, you agree to comply with these Terms of Use. Please read them carefully.

Protection of minors

You must be at least 16 years old to use our services. For users located in countries where the ‘digital age of majority’ differs (between 13 and 16 years old), the applicable legal age is that of the country of residence. Minors must obtain permission from a legal representative before creating an account. MLD reserves the right to delete any account created in violation of these rules.

Article 2 - Services Offered

My Language Drill Sàrl offers products designed for language learning and practising various language skills (grammar, vocabulary, listening comprehension and reading comprehension).

Our services include data updates, corrections where necessary, and remote access to databases.

Data processing responsibility

Depending on the type of customer:

  • For private customers, MLD acts as the data controller, in accordance with the nLPD and the GDPR.
  • For companies, schools or public institutions, these entities are responsible for processing the data of their end users. MLD acts as a processor and provides a Data Processing Agreement (DPA) in accordance with the nLPD and the GDPR (Art. 28 GDPR).

Article 3 - Hosting and Security

  • MLD hosts your data on servers located in Switzerland.
  • We take all reasonable measures to protect your data against unauthorised access, loss, destruction or modification.
  • Your data is encrypted at rest (storage) and in transit (transfer via the network).
  • Intrusion detection and malware detection tools are deployed on our servers.

Article 4 - Invoicing and Payments

  • Hosting fees are billed monthly or annually for private customers, depending on the package chosen at the time of subscription.
  • Subscriptions via our partner Payrexx are billed immediately.
  • In the case of a public institution or company, payments must be made by bank transfer within thirty (30) days.
  • MLD reserves the right to change the terms of payment, in which case you will be notified within a reasonable period of time.

Article 5 - Customer Responsibilities

The Customer undertakes to:

  • provide accurate and up-to-date information when registering,
  • keep their login details confidential,
  • have the necessary equipment and connections to use the service,
  • use the service in accordance with the law and these Terms of Use

Article 6 - Limitation of Liability

MLD implements high security measures, but cannot guarantee uninterrupted service availability.

MLD cannot be held liable in the event of:

  • interruptions due to force majeure,
  • network failures or actions by third parties,
  • indirect damage, loss of data attributable to the user or third parties.

Article 7 – Termination

  • The subscription is automatically renewed each month or each year depending on the package chosen.
  • Cancellation can be made at any time via our platform or via Payrexx.
  • For businesses: thirty (30) days' notice.
  • For public institutions: one (1) year's notice.
  • In the event of non-payment, MLD may suspend or terminate access.

Article 8 - Data Protection

By using our services, you agree that your data will be processed in accordance with our privacy policy, which complies with Swiss data protection legislation.

Article 9 – Users' Rights

In accordance with applicable legislation (nLPD and, where applicable, GDPR), you have the following rights regarding your personal data:

  • right of access,
  • right of rectification,
  • right to erasure (‘right to be forgotten’),
  • right to restriction of processing,
  • right to object,
  • right to data portability,
  • right to withdraw your consent.

Article 10 - Amendments to the Terms of Use

MLD reserves the right to amend these Terms of Use at any time. Amendments shall take effect as soon as they are published on our website. You will be notified of any major amendments.

Article 11 - Applicable Law and Jurisdiction

These Terms of Use are governed by Swiss law. Any dispute relating to the interpretation or execution of these Terms of Use shall fall under the exclusive jurisdiction of the courts of the Canton of Vaud.
